Gibtelecom Ltd Leased Lines authorisation requirements and conditions for the attachment of terminal equipment
In accordance with its License Obligations, Gibtelecom is to provide information on the authorisation requirements and conditions for the attachment of terminal equipment to its Private Leased Lines. These are set out below.
Service / Product Definition
National Private Leased Line (NPLC)
An NPLC is a point to point high bandwidth connection that allows businesses to connect their office networks at different locations within Gibraltar.
A full range of bandwidth options are available enabling you to easily select the exact bandwidth that matches your current business needs.
Bandwidth access is available on 64kbps, 128kbps, 256kbps, 512kbps, 1024kbps and 2048 kbps.
Customers are required to enter into an agreement with Gibtelecom for the provision of a Leased Line service. In addition, the customer is required to show that –
o it has obtained all authorisations, permissions, licences, consents and approvals necessary;
o the Premises are suitable; and
o it has provided all such equipment, connections (including electrical connections) fittings, facilities and conditions as are required, for the proper delivery, installation, connection, operation, continuing use and maintenance of the Circuit at or from the Premises.
The Customer shall ensure that, at the Premises, there is available a secure and uninterrupted electricity power supply that is suitable for the proper installation, connection, operation, continuing use and maintenance of the Circuit.
The Customer shall only use the Circuit, subject to, in accordance with and as set out in its agreement with Gibtelecom.
The Customer shall not, nor will it authorise or permit any other person to, use the Circuit in any one or more of the following manners or for any one or more of the following purposes (or both), as the case may be:
o for any unlawful purpose;
o in any unlawful manner;
o to violate or infringe any rights of, or to cause unwarranted annoyance, inconvenience or anxiety to, any third party;
o in breach of any direction or guidance given by the Gibraltar Regulatory Authority or any other competent authority;
o in breach of the terms and conditions subject to which a licence, authorisation or permit may have been granted to Gibtelecom, to a company that is within Gibtelecom’s group of companies or to the Customer;
o in such a way as to constitute a contravention or violation of any laws or regulations of Gibraltar or of any country, territory or jurisdiction;
o to send or receive any material which is defamatory, offensive, abusive, indecent, obscene or menacing;
o to send or receive any material in breach of any rights whatsoever including, but without prejudice to the generality of the foregoing, in breach of confidence, privacy, trade secrets, or in breach of any third party intellectual property rights (including copyright);
o if such use does not comply with the terms of any legislation or any licence, permit
or authorisation that may have been granted to the Customer;
o as a means of communication for a purpose which is prohibited under its agreement with Gibtelecom;
o in breach of such written instructions as Gibtelecom or the Gibraltar Regulatory Authority or both may have given to the Customer in respect of the use of the Circuit;
o other than in conformance with such terms and conditions in respect of the use of the Circuit as may, from time to time, be notified by Gibtelecom to the Customer;
o if such use does not comply with any instruction or direction given by Gibtelecom, any other relevant public telecommunications operator or any competent authority;
o if such use would put Gibtelecom in breach of the terms of any agreement that Gibtelecom may have entered into and notified in writing to the Customer;
o in a manner which causes or may cause damage to any network or equipment (or both) owned or used (or both) by Gibtelecom;
o in a manner which may, in the sole opinion of Gibtelecom, bring Gibtelecom into disrepute.
Gibtelecom may restrict, interrupt or deny access to and use of the leased line on the grounds of essential requirements. These include the protection of data, interoperability of services, network security and maintenance of network integrity. It will nonetheless make every endeavour to maintain the provision of the service.
Gibtelecom will take all reasonable steps to inform its Customers of the date when the emergency situation commenced, terminated and the nature and extent of any restrictions of the service.
Conditions for the connection of terminal equipment
If the Customer is, at any time, permitted under its agreement with Gibtelecom to connect equipment to the Circuit, the Customer shall only do so if such equipment –
o has first been type approved by the European Union for the purpose for which it is required;
o complies with such conditions as the Minister for Trade, Employment and Communications, after consultation with the Gibraltar Regulatory Authority, by regulation prescribe as being necessary for the connection of that equipment; and bears the “CE” marking.
